Membership at The Private Gym permits Member to use the Private Gym’s facilities during the membership term subject to such rules, regulations and conditions as may be in effect from time to time at the gym. Hours and days of operation, rules, regulations and conditions of use may be posted at the gym from time to time and shall be subject to change. The Private Gym will be closed on major holidays and will close over the Christmas period (from December 23rd until January 2nd) and also close for one week in the spring and one week in the summer. The membership rates have been established with this is mind and no refunds or discounts are given for these periods.

Membership and cancellation policies
Membership plans are determined by total sessions per month. No credits, discounts or refunds for missed sessions can be granted regardless of the circumstances.
Monthly dues continue on a month to month basis unless member provides written notification of his/her intent to cancel membership. Notification must be received in writing no later than the 20th of the prior month.
Cancellation forms are available at The Private Gym. Written cancellation can be mailed to P.O. Box 70181, San Diego, CA 92167.  Email cancellations can be sent to info@theprivategym.com.

Rules and regulations

1. You will be in default if you breach any of these agreement terms or conditions, or if you fail to pay any installment within 3 business days after the date when such installment is due. If you are in default, your membership privileges may be denied and the remaining balance under this agreement may become immediately due and payable.
2. No deduction or credit from any payments or sessions shall be made by reason of absence of Member or withdrawal of Member from the Private Gym, or by any reason of Member’s failure to use The Private Gym’s facilities.
3. Memberships are non-refundable, however they can be transferred with manager authorization.
4. Failure to regularly attend and utilize the gym facilities does not relieve member of their obligations, regardless of the circumstances, to pay the EFT in full.

Personal Training appointments

1. Member understands that 24 hour notice of cancellation is required for personal training appointments. Member understands that all appointments cancelled without 24 hour notice will be lost.
2. Member understands that if their appointed Personal Trainer is unavailable for any reason, a substitute will be provided.

ASSUMPTION OF RISK, WAIVER AND RELEASE OF LIABILITY AND INDEMNITY AGREEMENT

1. Assumption of risk: In consideration of being allowed to participate in the activities

and programs of The Private Gym and to use it’s facilities, equipment and machinery, Member waives, releases and forever discharges The Private Gym and it’s representatives, employees, affiliates, agents, successors and assigns from any and all responsibilities or liability from injuries or damages resulting in Member’s participation in any activities, including, but not limited to: weight lifting, walking, jogging, running, stretching, boxing, kickboxing and aerobic activities. Member agrees that they are voluntarily participating in the aforementioned activities and use of the facilities and premises and understands that participation in fitness activities involve a risk of injury and even death and assumes all risk of injury, damage or loss to themselves or their property that might result, including any loss or theft of personal property.

1. Release: Member agrees on own behalf to release and discharge The Private Gym and it’s representatives, employees, affiliates, agents, successors and assigns from any and all claims or causes of action (known or unknown) arising out of the negligence of The Private Gym, whether active or passive. This waiver and release of liability includes,

Without limitation, injuries which may occur as a result of a) your use of any exercise equipment or facilities which may malfunction or break, b) The Private Gym’s improper maintenance and inspection of any exercise equipment, premises or facilities, c) The Private Gym’s negligent supervision and d) you slipping or falling while on the facility or any portion of the premises for any reason.

INFORMED CONSENT: Member understands and is aware that participation in fitness activities and equipment involve a risk of injury and even death and is participating voluntarily in these activities and using equipment and facilities with knowledge of the dangers involved. Member agrees to assume and accept all risks of injury and death.
Member declares themselves to be physically sound and suffering from no condition, impairment, disease, infirmity or other illness that would prevent participation in exercise and fitness activities, machinery and equipment. I also acknowledge that it has been recommended that I have a yearly or more frequent physical examination and consultation with my physician as to physical activity, exercise and training equipment so that I might have his/her recommendations concerning these fitness activities and equipment use. I also acknowledge that I have had either a physical examination and been given my physician’s permission to participate, or I have decided to participate in activity and use of equipment and machinery without the approval or my physician and do hereby assume all responsibility for my participation and activities and utilization of The Private Gym’s equipment, facility, representatives, employees, affiliates, agents, successors and assigns.]

MEMBERSHIP RULES: Member agrees to keep and obey all rules and regulations now in force or in the future prescribed by The Private Gym, or it’s associated Companies, for the use of the gym facilities and the equipment therein, including rules with respect to attire and personal hygiene. The Private Gym reserves the right to revoke this membership, suspend or cancel at it’s sole discretion.

1. Members must carry a towel (provided by The Private Gym) and wipe up their sweat after using equipment.
2. Members must help keep the gym floor safe by returning free weights and other equipment to designated areas.
3. No food or drink (other than water) is permitted on the gym floor.
4. No smoking, tobacco or gum chewing in any area of The Private Gym.
5. Damage to property shall be paid for by Member for any willful or neglectful cause of such damage. Members are responsible for damage incurred by dependent children or guests.
6. Member shall be subject to the control and guidance of The Private Gym’s staff and follow their instructions while in the facility. Member agrees to conduct themselves in a quiet and well mannered fashion when in or about the facility so as not to cause any disturbances which would interfere with the use and enjoyment of the gym by other members and guests. Under no circumstances will Member use foul, loud or slanderous language, or harass, molest, badger or solicit other members, guests or staff. Member shall not use equipment in any manner not authorized by The Private Gym’s staff and representatives. Any complaints, other than those of an emergency nature or requiring immediate action by The Private Gym’s staff shall be made directly to the manager, in private, so as to avoid possible embarrassment to other members. Member agrees to keep and obey all rules and procedures now in force or in the future established by the gym. The provisions in this paragraph are vital to the successful operation of the gym. A violation of any of these provisions by Member could cause injury to another member or person using the gym’s facilities, injury to the staff, injury to the reputation of The Private Gym, damage to property and other persons or interference with rights granted to others using the gym.

GUEST POLICIES:

1. Members may bring in guests with prior notice.
2. Guests are required to sign a release of liability.
3. Guests may work out with member for $15 per visit.
